Terms of Service

1. Acceptance of Terms

By accessing or using Martial Arts Desk ("the Platform"), operated by Martial Arts Desk SpA ("we", "the Company"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Platform.

2. Service Description

Martial Arts Desk is a SaaS management platform for martial arts academies that allows you to:

• Manage practitioners, enrollments and promotions
• Manage schedules, attendance and class logs
• Process payments and memberships
• Record competitions and internal tournaments
• Generate reports and statistics

3. Registration and Accounts

To use the Platform, you must create an account providing truthful and up-to-date information. You are responsible for:

• Maintaining the confidentiality of your access credentials
• All activity that occurs under your account
• Notifying us immediately if you detect unauthorized use

We reserve the right to suspend or delete accounts that violate these terms or that remain inactive for more than 12 months.

4. Plans and Billing

The Platform offers different subscription plans with varying features and limits. By subscribing to a paid plan:

• Charges are made on a recurring basis according to the chosen billing cycle
• You can cancel your subscription at any time; access will continue until the end of the paid period
• Prices may change with at least 30 days prior notice
• No refunds are made for partial periods, except as required by law

5. Acceptable Use

You agree not to:

• Use the Platform for illegal or unauthorized purposes
• Attempt to access accounts, data or systems that do not belong to you
• Interfere with the operation of the Platform or its infrastructure
• Upload malicious, offensive content or content that infringes third-party rights
• Resell or redistribute access to the Platform without authorization
• Perform scraping, crawling or automated data extraction

6. Intellectual Property

The Platform, including its design, code, logos, texts and graphics, is the property of Martial Arts Desk SpA and is protected by applicable intellectual property laws. You retain all rights to the data you enter into the Platform.

7. Data and Privacy

The processing of personal data is governed by our Privacy Policy. By using the Platform, you act as the data controller for the personal data of your academy's practitioners and commit to:

• Having the necessary consent to enter third-party data
• Informing practitioners about the use of their data on the Platform
• Complying with applicable data protection legislation

8. Service Availability

We strive to keep the Platform available continuously, but we do not guarantee uninterrupted operation. We may perform scheduled maintenance with reasonable advance notice. We will not be liable for interruptions caused by factors beyond our control.

9. Limitation of Liability

The Platform is provided "as is". To the maximum extent permitted by law:

• We do not guarantee that the Platform will meet all your specific requirements
• We will not be liable for indirect, incidental or consequential damages
• Our total liability will not exceed the amount paid by you in the last 12 months

10. Termination

You may cancel your account at any time. We may suspend or terminate your access if:

• You breach these Terms of Service
• Your subscription expires and is not renewed
• Fraudulent or abusive activity is detected

In case of termination, you will have 30 days to export your data before it is deleted from our systems.

11. Modifications

We reserve the right to modify these terms. Significant changes will be notified by email or through a notice on the Platform at least 15 days in advance. Continued use of the Platform after the changes constitutes your acceptance.

12. Applicable Law and Jurisdiction

These terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of the city of Santiago, Chile.
